Even though they both measure blood alcohol content (BAC), if you refuse a breath test and request a blood test instead this counts as refusing the Breathalyzer test. If you refuse a Breathalyzer you could face:
- Automatic suspension of your driver's license for seven days
- Your license will be suspended for one year, without the option of applying for a restricted license
For a second conviction of breath test refusal (or another DUI conviction) within 10 years, your license will be:
- Suspended for three years with no possibility of getting a restricted license
- You will also face up to six months in jail and a fine up to $1,000.
A third conviction results in an indefinite license revocation.
